The anti-piracy law, which provides for pre-trial blocking of sites for distributing illegal content, entered into force on August 1 of this year and during this time managed to be criticized not only by Russian technological giants, but also by ordinary users. The special working group consisting of officials, rightholders and representatives of Internet companies in Russia is engaged in its revision. Last Friday, they again gathered to discuss amendments to the Civil Code of the Russian Federation and reached some agreements.
According to the Vedomosti newspaper, now the responsibility for the illegal placement of content will lie entirely on the respondent, even if the latter did not know about the illegality of his actions and did not derive income from it. The search engines this time managed to get away with the water - they will be exempt from liability if they remove links to websites that violate copyrights.
Previously, copyright holders sought content moderation in search engines. In this case, in the first place in the search results should be only links to legal resources that are not listed in the registry of prohibited sites. Nevertheless, representatives of the presidential administration rejected their demands, arguing that they did not want to "turn Russia into China."
But here there are some subtleties. From the moment the case is considered until a court decision is made, it may take several months, and all this time the site with illegal content will be displayed in search results. Therefore, the right holders insist on the removal of links to the site by search engines, as soon as they are informed of the violation.
At the meeting, four types of intermediaries were noted, which will be exempt from liability when deleting illegal content: search engines, hosters, mobile operators, as well as “link sites”. The last group includes torrent trackers, as they contain only links to illegal materials, but do not distribute them.
As the representative of Yandex noted, Internet companies cannot constantly monitor sites for the legality of the posted materials.
Google already practices the removal of links from its issue, but informs its users about it.

Now much depends on whether the removal of links to sites from search results without a court order will be implemented. IT giants are strictly against this initiative, so in the future, the working group will address this issue.
